Terms of Use

By registering an account, making a booking, or otherwise accessing Indian Tours Travels's platform (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy, which is incorporated herein by reference.

These Terms constitute a legally binding agreement between you ("User", "you") and Indian Tours Travels ("Company", "we", "us", "our"), a company registered in India.

Indian Tours Travels provides an online platform to book the following transportation services across India:

• Outstation Rentals — One-way and round-trip intercity travel between cities.
• Airport Transfers — Scheduled pickups and drops to and from airports, with optional flight tracking.
• Hourly Rentals — Within-city car hire by the hour for business meetings, errands, or leisure.

Indian Tours Travels acts as a technology platform connecting users with independent drivers and vehicle operators ("Vendors"). We are not a transportation company or a common carrier. The actual transportation service is provided by Vendors, and Indian Tours Travels is not liable for their actions or omissions beyond what is expressly stated herein.

• You must be at least 18 years of age to use our services.
• You must have a valid mobile number registered in India for OTP-based authentication.
• You must have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
• You must not have been previously suspended or removed from our platform for violations of these Terms.

To book a service, you must register an account using your mobile number. Authentication is performed via a one-time password (OTP) sent through Firebase Phone Authentication.

• You are responsible for maintaining the confidentiality of your account and all activities that occur under it.
• You agree to provide accurate and up-to-date information during registration.
• You must notify us immediately at legal@indiantourntravels.in if you suspect any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion, with or without notice.

A booking is confirmed only after you receive a confirmation notification (SMS, email, or in-app) from Indian Tours Travels. Until such confirmation is received, no contract exists between you and the Vendor.

• You are responsible for providing accurate pickup locations, drop locations, dates, and times.
• For airport transfers, you should provide the correct flight number to enable tracking. Indian Tours Travels is not liable for missed pickups due to incorrect flight information.
• Confirmed bookings are subject to driver and vehicle availability. In rare cases of unavailability, we will notify you promptly and process a full refund.
• It is your responsibility to be present at the pickup location at the scheduled time. Waiting time beyond 15 minutes (airport pickups: 30 minutes after landing) may result in additional charges or booking cancellation without refund.

All prices displayed on the platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

• No hidden charges: The fare shown at booking confirmation is the final fare, subject to conditions below.
• Toll charges: Applicable tolls during the trip are borne by the user and are not included in the base fare unless explicitly stated.
• Night surcharge: Rides between 11:00 PM and 6:00 AM may attract an additional night surcharge.
• Extra kilometres/hours: For hourly rentals, usage beyond the booked package will be billed at the per-km/per-hour rate shown at booking.
• Payment methods: We accept credit/debit cards, UPI, net banking, and other methods available via our payment gateway. All transactions are processed securely and we do not store your card details.
• Failed payments: If a payment fails after booking, your booking will not be confirmed. Please retry or use an alternate payment method.

Refunds are processed to the original payment method within 5–7 business days. Cancellations must be made through the app or website. Refund timelines depend on your bank or payment provider.

Indian Tours Travels reserves the right to cancel a booking due to driver unavailability, safety concerns, natural disasters, or circumstances beyond our control. In such cases, a full refund will be issued.

By using our services, you agree not to:

• Provide false or misleading information during booking or registration.
• Use the service for any illegal purpose or in violation of applicable Indian laws.
• Harass, threaten, or abuse drivers, vendors, or Indian Tours Travels staff.
• Damage or misuse any vehicle provided by a Vendor.
• Carry prohibited items (explosives, illegal substances, weapons) in the vehicle.
• Smoke inside the vehicle. A cleaning fee of ₹500 may be levied for violations.
• Exceed the seating capacity of the vehicle.
• Attempt to access, scrape, or reverse-engineer our platform.
• Use automated bots or scripts to make bookings.

Violation of these conduct rules may result in immediate termination of the booking without refund and permanent suspension of your account.

To the maximum extent permitted by applicable law, Indian Tours Travels shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from the use or inability to use our services.
• Loss of data, revenue, profits, or goodwill.
• Delays or cancellations caused by traffic, weather, acts of God, or other circumstances beyond our control.
• Actions or omissions of independent Vendors or drivers.
• Personal injury or property damage during the trip (covered by the Vendor's insurance).
• Accuracy of third-party information such as maps, flight data, or traffic conditions.

In no event shall Indian Tours Travels's total liability to you exceed the amount paid by you for the specific booking giving rise to the claim.

All content on the Indian Tours Travels platform — including but not limited to text, graphics, logos, icons, images, audio clips, and software — is the property of Indian Tours Travels or its content suppliers and is protected under Indian and international intellectual property laws.

You may not:

• Reproduce, distribute, or commercially exploit any content from our platform without prior written consent.
• Use our trademarks, logos, or brand elements without authorisation.
• Create derivative works based on our platform or content.

You agree to indemnify, defend, and hold harmless Indian Tours Travels, its officers, directors, employees, agents, and Vendors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any applicable law or the rights of a third party.
• Any content or information you submit through the platform.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

For consumer disputes, you may also approach the appropriate consumer forum under the Consumer Protection Act, 2019.

Indian Tours Travels reserves the right to modify these Terms at any time. We will notify you of significant changes via SMS or email. The updated Terms will be effective from the date displayed at the top of this page. Continued use of our services after the effective date constitutes your acceptance of the revised Terms.
